Breakspot Terms of Use

An on-device linear estimate for everyday prints – hooks, mounts, and brackets. Not a lab test. Not a professional engineering service.

These Terms of Use license the Breakspot iOS app from Kickstart Ai LLC, doing business as Kick-Start.ai. They are a conservative product draft for counsel review: limitation of liability and indemnity are stated without a dollar cap or a chosen governing-law state. App Store billing and refunds are handled by Apple. If Apple’s purchase terms conflict with these Terms on a payment, Apple’s terms control that transaction.

1. Who we are

Breakspot is published by Kickstart Ai LLC, doing business as Kick-Start.ai. Product page: kick-start.ai/breakspot. Contact: info@kick-start.ai or kick-start.ai/contact. A public mailing address will be added here when the publisher confirms it; do not treat a missing street line as a different legal entity.

2. License

We grant you a personal, non-exclusive, non-transferable license to use Breakspot on Apple devices associated with your Apple ID, solely to screen everyday printed parts as described in the app. We do not sell you the solver, the bundled example parts, or any professional engineering service. Breakspot does not issue a professional engineer’s seal, stamp, or signed opinion.

3. What Breakspot is

Breakspot provides an on-device linear elastic screening estimate. It is not a professional engineering service, not a laboratory test, and not a certificate that a part is safe. Results are qualitative bands – no obvious hotspot, uncertain, or likely problem – plus a relative heatmap. They are not a predicted breaking load. You must physically load-test any print before relying on it. If a result and the real world disagree, trust the real world and the physical part, not the PDF or share card.

4. Prohibited uses

Do not use Breakspot for children’s products, firearms, climbing, aviation, medical devices, safety-critical parts, or anything that could injure someone if it fails. You are responsible for how you print and use a part.

5. Files you import

You represent that you have the right to import each file you open in Breakspot (including third-party CAD). We do not claim ownership of your meshes. Processing stays on your device as described in the Privacy Policy.

6. No warranty

Breakspot is provided AS IS, without warranties of any kind, including implied warranties of merchantability, non-infringement, and fitness for a particular purpose. Screening numbers, bands, and heatmaps can be wrong. Catalog material thresholds are not a material certificate.

7. Limitation of liability and indemnity

To the maximum extent permitted by law, Kickstart Ai LLC is not liable for personal injury, property damage, reprint cost, lost profits, or other damages arising from use of Breakspot or reliance on a Check, share card, or PDF. A specific dollar cap and governing-law state are reserved for counsel and are not set in this draft. You agree to defend and indemnify Kickstart Ai LLC against claims arising from prohibited uses, from treating a screening estimate as a safety certificate, or from files you imported without rights.

8. Breakspot Pro

The public offers are monthly and yearly Breakspot Pro, billed by Apple as auto-renewing App Store subscriptions. In the U.S. App Store the listed prices are $4.99 per month USD and $34.99 per year USD; other regions follow Apple’s local prices. Payment is charged to your Apple ID at confirmation of purchase. The subscription renews unless you turn off auto-renew at least 24 hours before the end of the current period. Manage or cancel in Apple ID subscription settings. Refunds, if any, are handled by Apple under Apple’s rules, not by Kickstart Ai LLC. The demo shelf bracket remains free. You also get one Check on a part you import. Lifetime unlock is not offered as a buy option. Existing lifetime purchases for this Apple ID still unlock Pro.

9. Open-source notices

Breakspot includes third-party code and example parts. License texts are shown in the app under Settings → Acknowledgments (Quartet ISC, meshoptimizer MIT, example parts CC BY 4.0). Those notices are part of these Terms.

10. Privacy

How the app handles information is described in the Breakspot Privacy Policy.

11. Changes

We may update these Terms. The “Last updated” date at the top will change when we do. Material changes may also be noted in the App Store listing or in-app, including a new acknowledgment before Check. This page does not treat mere continued use as consent.
